Terms of Service

These terms are written in plain language because we believe you should understand the rules without a law degree. By using Merc Mercado, you agree to these terms.

The basics

  • Merc Mercado is a marketplace that connects makers with buyers. We don't sell goods ourselves.
  • We charge zero platform fees. Sellers keep 100% of what they earn.
  • All payments happen off-platform (Venmo, Zelle, cash, etc.). We never handle your money.

For sellers

  • Handmade only. Everything listed must be made by hand — by you or your studio. No mass-produced goods, no dropshipping, no reselling factory items.
  • Honest listings. Describe your work accurately. Use your own photos. State the real condition.
  • Phone verification required. Before your first listing goes live, you must verify your phone number.
  • Honor your commitments. If you accept an offer, follow through. Repeated cancellations affect your trust score.
  • Your prices, your rules. Set whatever price you want. Negotiate directly with buyers.

For buyers

  • Real inquiries only. Don't waste sellers' time with fake interest or lowball spam.
  • Honor your commitments. If you confirm an offer, follow through on payment.
  • Rate honestly. The rating system only works if people are truthful. Retaliatory ratings are flagged and removed.

For everyone

  • Be respectful. No harassment, hate speech, threats, or discrimination in messages or listings.
  • One account per person. Don't create multiple accounts to manipulate ratings or evade bans.
  • No illegal goods. Don't list anything illegal to sell in New Mexico.
  • Report problems. If something feels wrong, use the "Need help?" button or email us.

How the offer system works

  1. Buyer sends an offer with a price and meetup preference.
  2. Seller can accept, decline, or counter.
  3. When both parties tap "I Confirm," a digital invoice is generated.
  4. Payment and pickup are arranged directly between buyer and seller.
  5. After the transaction, both parties rate each other. Neither rating is visible until both are submitted.

What we can do

We reserve the right to:

  • Remove listings that violate these terms.
  • Suspend accounts that repeatedly break rules.
  • Remove fraudulent ratings.
  • Modify these terms (we'll update the date and notify active users).

What we're not responsible for

  • The quality of goods sold on the platform. We connect people; we don't inspect products.
  • Payments between buyers and sellers. Those happen off-platform.
  • Disputes about pricing, condition, or delivery. We'll help mediate, but we're not an arbiter.

Intellectual property

You own your content (photos, descriptions, bio). By posting on Merc Mercado, you grant us a license to display it on the platform. If you delete your listing, we remove it.

Termination

You can delete your account at any time. We can suspend or terminate accounts that violate these terms. If your account is terminated, your listings are removed and your data is deleted within 30 days.
